Terms and Conditions

Please read these terms of use carefully before you start to use our website or order any products from it. By using our website and/or placing an order you indicate that you accept these terms and conditions and agree to be bound by them. Your statutory customer rights are not affected.

Definitions

Seller means The Warm Welly Company registered as a Limited Company in the United Kingdom, Company Registration Number 5798801, Registered Office and Trading Office: Hillfield, Walton, Brampton, Cumbria CA8 2AZ. and the company’s website www.warmwellies.co.uk.

Customer means the person or company to whom this document is addressed. 

General

These terms and conditions are applicable to the supply of products made by the Seller to the buyer hereafter referred as the Customer.

Price

All prices are quoted in British Sterling inclusive of Value Added Tax (VAT) at the current rate. VAT is not currently applicable to children's clothing or footwear.

We always try to make sure that the prices on our Site are correct but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming the order at the correct price or cancelling it. If the order is cancelled we will refund you in full.

Payment

Payments are made in British Sterling by one of the following payment methods: Visa, MasterCard, Delta, Cirrus, Maestro, Visa Electron, American Express & Paypal.

Payment is taken at the point of ordering. All orders are subject to security checks to protect our customers. Please ensure the billing address provided is the address registered with your card issuer as incorrect information may delay your order.

Sales Contract

As per the Consumer Contract Regulations (2013) the Seller is under a legal duty to supply goods that are in conformity to the contract. 

Risk & Title

The Seller shall retain the property of the goods until full payment has been made by the Customer.

The risk in the goods shall pass to the Customer on delivery.

If you believe that a parcel has been tampered with, it is your responsibility to refuse to sign for the goods.

In the event of a damaged or lost parcel, we will forward a claim to the appropriate courier on the behalf of the Customer and liaise with the Customer to replace or recover the missing item(s). 

Shipping & Delivery

All items are subject to stock availability.

The majority of orders are despatched within five working days. If we are aware of any delay we will attempt to contact you via telephone and/or email.

Orders are shipped via Courier or Royal Mail tracked services.

If an item is required by a specific date please contact our Customer Services Team for assistance.

Delivery dates and times provided are indicative and should not be considered a guarantee. We cannot be held responsible for delays and will not offer compensation for delay.

You are able to specify a safe place to leave your order if you are not at home to receive it.

Claims of damage or incomplete delivery must be notified in writing both to the carriers and the Seller within 10 days of receipt, and our packaging must be retained for investigation. Claims cannot be accepted outside these time limits.

Claims for non-delivery must be made within 14 days of receipt of dispatch confirmation.

Claims of damage, incomplete delivery or non-delivery may take up to 14 working days to investigate and resolve. Replacements or refunds will not be issued until a full investigation has been completed. 

Acceptance

The Customer will inspect the goods within a reasonable time of receipt. If cancellation notification is not received within 14 days of receipt, and the goods not returned to us within this time, we shall assume that the goods have been accepted as suitable and as described. Returns for exchange/store credit will only be considered at our own discretion after these deadlines.

Any worn, damaged, used or soiled goods will not be accepted for return.

Receipt of posting should be obtained. We cannot be held responsible for parcels that are lost in transit to us.

Please allow 28 days for your returned item to be delivered back to us. Returns are at the sender’s cost.

Returns made under order cancellation as per the Consumer Contracts Regulations are at the sender’s cost.  Returns will be refunded within 14 days of their receipt by the Seller, using the same means of payment used for the initial transaction, unless you have requested otherwise.

Where rejection of the goods is due to a defect in an item, the Customer is entitled to a replacement. Please contact us for assistance before returning such item(s). We may request the faulty or damaged product to be returned before the replacement can be issued. Reasonable postage costs will be refunded to the customer on inspection of the goods and confirmation of fault, only if the Seller has previously authorised the return and issued a Returns Authorisation Number.

Your Right to Cancel

Customers wishing to exercise their right to cancel under the Consumer Contracts Regulations (2013) must do so within 14 days of the receipt of their order, either by emailing sales@warmwellies.co.uk or by letter to: The Warm Welly Company, Hillfield, Walton, Brampton, Cumbria CA8 2AZ.

Returns made under order cancellation as per the Consumer Contracts Regulations are at the sender’s cost.

Goods should be returned without delay and not later than 14 days from the day on which you notify us of your wish to cancel.

A full refund will be offered, except for expedited delivery charges.

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. An example of unnecessary handling would be you having done something with the Goods other than try them on or inspect them in the way you would in a shop.

We are the owner or the licensee of all intellectual property rights on our website. All trademarks, graphics and pictures shown belong to their registered owners and are protected by copyright laws, and must not be copied or reproduced without prior permission.
